Jenelle Evans’ son Jace will be expected to testify in court against his mom’s ex-husband, David Eason. A court source has confirmed that the case is still open and David will appear in front of a judge soon. Here is what has been revealed.
Jace Evans Will Appear In Court To Testify Against David
It has been a year since the alleged abuse incident between David Eason and Jace Evans. However, Jenelle’s ex-husband is very much still on the hook for the charges against him.
A source told The U.S. Sun, “The case against David is still pending, absolutely. It will be calendared when it’s ready for David to come up for charges, and his charges got upgraded to a felony on January 10th of 2024.”
When the case is added to the court’s calendar, it will be for a felony trial. A second source said that Jace will be expected to testify at the trial in the future.
As we previously reported last year, Jenelle Evans’ son Jace informed police that David strangled him during an altercation on September 28, 2023. The entire ordeal played out in front of a neighbor’s house in North Carolina.
The source added, “Jace is adamant about going to testify. He can’t wait to take the stand. He hates David.” The District Attorney’s office is apparently helping Jace prepare to testify.
Then, Jace ran away from Jenelle’s house for a third time following the incident with David. Child Protective Services stepped in and took custody of Jace. Earlier this year, the CPS case was dropped and Jace was returned to her custody.
David Eason wasn’t in the home when Jace returned though. He reportedly moved out and has been living on the couple’s boat. This was because there was a restraining order against him and he could not be around Jenelle Evans’ oldest child.

Jenelle’s ex is facing some hefty charges. He’s looking at felony battery by strangulation and misdemeanor child abuse charges following his attack on Jace last year. David was indicted on the charges earlier this year.
Since their split, Jenelle Evans has requested primary custody of her seven-year-old daughter Ensley, whom she shares with David. In August, she was awarded temporary sole custody of Ensley.
She has also petitioned for child support and has asked that the court distribute the martial assets in her favor. Jenelle is seeking ownership of the family’s home and points to threatening statements made by David.
“Defendant has made several statements that plaintiff cannot keep him from ‘his’ home,” court documents read. “Plaintiff is in need of the sole use enjoyment and possession of the property for the benefit of plaintiff and the minor children and hereby request this court to enter an order sequestering the property for the benefit of plaintiff and the minor children.”
